Intensity Expert Article on Georgia-Pacific factors chosen as the Licensing Executive Society International’s Article of the Month for March 2016

Ryan Sullivan published an article entitled, “Downgrade to ‘Neutral’: A Diminishing Role of the Georgia-Pacific Factors in Reasonable Royalty Analyses” became the March 2016 Article of the Month for the Licensing Executive Society International (LESI) organization.
In that article, Intensity expert Dr. Sullivan considers the appropriate role of the Georgia-Pacific factors in patent litigation, particularly in the context of economic damages for patent infringement. “Because the Georgia-Pacific factors are neither mutually exclusive nor collectively exhaustive with respect to relevant economic issues, their utility in quantifying a reasonable royalty is inherently limited,” stated the author, adding, “an approach that focuses on applying sound economic principles to case specific facts, rather than rote iteration of all fifteen Georgia-Pacific factors, appears to be a wise way to proceed.”
